Receivers

The current global downturn and banking crisis in Ireland has unfortunately led to many company insolvencies in the construction, engineering and property-development sector. The financial difficulties encountered by banking institutions has resulted in little, if any, liquidity in the market and consequently there is an unwillingness of banks to continue to fund many development projects.

A Receiver is appointed over assets that are securitised on an underlying loan provided by banking institutions. The purpose of the appointment of a Receiver is to realise these assets in satisfaction of the underlying loan.

Given the unprecedented level of distressed assets in the current marketplace it is increasingly important to have the right exit strategy to maximise the value on these assets.

Today, in the case of insolvent construction and property development-companies, whose survival is now dependent on restructurings and insolvencies, Receivers need to have the ability to tap into specialised knowledge within these skill sets and other practice areas to formulate the most beneficial exit strategy.

NAMA

O’Dwyer Property Management has been appointed to the National Asset Management Agency (NAMA) professional service provider panel, for the provision of property management services related to enforcement and insolvency.

The purpose of NAMA is to address the level of impaired property and development loans on the balance sheets of Irish banks. NAMA is established as a statutory body corporate with extensive powers to acquire, hold and manage bank assets underlying these loans. It is anticipated that NAMA will acquire bank loans with underlying assets worth approximately €90 billion. it is important to have the right exit strategy to maximise the value on these assets.
